Cancellations: All deposits are non refundable, however, deposits may be transferred to a booking of similar value [not less value]. This offer is subject to availability and valid for a period of three months commencing original arrival date.
CANCELLED HOTEL BOOKINGS
The Legal Position
A contract for the reservation of accommodation at an hotel, guest house or similar establishment, whether in writing or not imposes an obligation on the proprietor to hold a room (or rooms) at the disposal of the guest for an agreed period and on the guest to pay for the accommodation so reserved.
If either party seeks to vary or cancel the contract, this can only be done by mutual agreement or, in the absencce of such agreement, subject to liability to ccompensate the other party for any loss occassioned there by.
Cancellation of a booking by a guest without the consent of the proprietor, or failure to arrive on the due date, whatever the reason, entitles the proprietor to claim compensation subject to the following conditions:
1 He must take all reasonable steps to re-let the accommodation and if successful, even for part of the period must reduce his claim accordingly.
2 Any claim for compensation must exclude items, such as food,
which have not been supplied, but extra expense incured trying
to re-let (e.g. advertising, faxes, telephone calls, etc.) may be
added.
3 If the guest has paid a deposit, this will not be returnable unless
the proprietor's claim is less than the deposit, in which case any
balance should be refunded.
In cases where claims for compensation have been decided by County Courts, hotel propritors are normally awarded damages on the basis of two-thirds of a full board booking, the remaining one-third being regarded as the value of food not supplied. It has also been held that illnessb does not entitle a guest to cancel the contract without compen- sation to the proprietor.
